The practical terms for estimates, confirmations, payments, cancellations, passenger safety, text messages, approved transportation partners, and private transportation with Gulfshore Rides.
These Terms of Use ("Terms") govern access to and use of https://gulfshorerides.com, its fare and trip-planning tools, booking links, forms, communications, and private transportation services offered by Gulfshore Rides LLC ("Gulfshore Rides," "we," "us," or "our").
Please read these Terms before requesting or using a ride. These Terms work together with our Privacy Policy, the written confirmation for a particular ride, and any fare, cancellation, or service terms clearly disclosed and accepted for that ride.
1. Acceptance and Scope
You accept these Terms when you submit a booking request, confirm or pay for a reservation, or use a transportation service after receiving reasonable notice of these Terms. Accessing the public website is subject to the website-use provisions below, but merely browsing the website does not create optional SMS, marketing, location, cookie, or transportation-partner consent.
If you do not agree to these Terms, do not submit a booking request or use our transportation services. If you use the services for another passenger or organization, you represent that you are authorized to arrange the ride and agree to communicate the applicable ride terms to the passenger.
2. About Gulfshore Rides
Gulfshore Rides provides private, appointment-based transportation, including airport transfers, cruise-port transfers, hotel, residence, and business pickups, hourly service, and related private-car services in Southwest Florida and other confirmed service areas.
Availability depends on schedule, route, vehicle and driver availability, passenger and luggage requirements, accessibility needs, weather, traffic, airport or port conditions, applicable law, and other operational factors. A website description does not guarantee service for a particular date, time, route, or vehicle.
3. Eligibility and Bookings for Others
You must be at least 18 years old and legally able to enter a contract to make a reservation. A parent, guardian, or responsible adult must arrange transportation for a minor. We may require an adult passenger or written advance approval for an unaccompanied minor.
If you book for another person, you are responsible for providing accurate passenger information, obtaining permission to provide that information, and ensuring the passenger receives pickup instructions and applicable ride terms. The booking contact remains responsible for authorized charges unless Gulfshore Rides agrees otherwise in writing.
4. Permitted Website Use
You may use the website only for lawful, personal, and legitimate business purposes related to learning about or requesting Gulfshore Rides services. You may not:
- Violate any applicable law or another person's rights.
- Submit false, misleading, incomplete, fraudulent, or unauthorized information.
- Impersonate another person or misrepresent authority to arrange a ride.
- Interfere with website security, operation, availability, forms, or booking tools.
- Introduce malware, automated abuse, spam, or harmful code.
- Scrape, harvest, copy, or exploit website content, pricing, routes, or customer-facing tools for a competing or unlawful purpose.
- Harass, threaten, discriminate against, defraud, or harm Gulfshore Rides, its drivers, customers, partners, or any other person.
We may restrict website access or reject a request when reasonably necessary to address fraud, abuse, security, safety, legal, or operational risk.
5. Trip Requests and Reservation Confirmation
A trip request, Fare Finder result, Trip Planner submission, form submission, telephone call, text, email, or third-party booking inquiry is not a confirmed reservation. A reservation is confirmed only when Gulfshore Rides provides an express confirmation identifying the accepted trip or otherwise clearly communicates that the reservation is booked.
You are responsible for checking the confirmation and promptly reporting errors. Required details may include the passenger and booking-contact names, telephone number, email address, pickup and drop-off locations, date and time, airline and flight number, cruise or terminal information, passenger and luggage counts, child-seat or accessibility needs, pets, stops, and special instructions.
We may decline or cancel a request for a lawful reason, including unavailable service, incomplete or inaccurate information, suspected fraud, unsafe conditions, abusive conduct, an impractical route, capacity limits, or a request outside our operational ability. If Gulfshore Rides cancels a confirmed prepaid ride for reasons within our control and does not provide an accepted substitute, we will refund the amount paid for the unprovided ride.
6. Fare Finder, Trip Planner, and Estimates
Fare Finder, Trip Planner, website, telephone, text, and email results are estimates or requests unless Gulfshore Rides expressly confirms a final fare in writing. Estimates may depend on the information entered and may change when the itinerary, timing, stops, passenger count, vehicle, luggage, accessibility, child-seat, pet, or other requirements change.
Where a Fare Finder result states that tolls or airport or cruise-port pickup wait time are included, that statement controls for the quoted itinerary. Gratuities are not included unless expressly stated. Parking, extended wait time, additional stops, special vehicle requirements, after-hours service, same-day changes, or other items are charged only when disclosed in the confirmation, reasonably caused by a customer-requested change, or separately approved by the customer.
We may correct an obvious pricing or data-entry error before a reservation is confirmed. After confirmation, Gulfshore Rides will not change the agreed fare solely because website pricing later changes; a revised price may apply when the customer requests or accepts a material trip change.
8. Cancellations, Changes, Refunds, and No-Shows
Unless a different cancellation policy is clearly disclosed and accepted in the written confirmation:
- A cancellation received at least 24 hours before the confirmed pickup time is eligible for a full refund of the amount paid for that canceled ride.
- A cancellation received less than 24 hours before pickup may be subject to a reasonable cancellation fee based on the confirmed fare, driver dispatch, and nonrecoverable costs.
- A no-show may be subject to a reasonable no-show fee based on the confirmed fare and documented dispatch, parking, or operational costs.
A no-show may occur when the passenger does not appear at the confirmed location, cannot be reached after reasonable attempts, supplies an incorrect location or materially incomplete contact information, or remains unavailable after the confirmed or reasonably communicated grace period.
Tell us promptly about changes. A material change to the date, time, route, stops, passenger or luggage count, vehicle, airport, flight, cruise, child-seat, accessibility, or pet requirements is subject to availability and may require a revised confirmation and fare. A requested change is not accepted until Gulfshore Rides confirms it.
Approved refunds are generally returned to the original payment method unless another method is agreed. Processor or financial-institution timelines may affect when funds appear.
9. Airport, Cruise-Port, and Flight Coordination
When you provide a flight number, we may use third-party flight information to help coordinate pickup. Flight tracking is an operational aid and may be inaccurate, delayed, or unavailable. You remain responsible for notifying us of material airline, airport, terminal, flight, cruise, arrival, departure, luggage, or pickup-location changes.
Pickup instructions, meeting locations, included wait time, grace periods, parking, and extended-wait charges may differ by airport, port, terminal, and reservation. The written confirmation and reasonable real-time driver or dispatcher instructions control for the ride.
Allow sufficient travel time. Gulfshore Rides cannot guarantee arrival by a flight, cruise, appointment, or other deadline when timing is affected by traffic, security, weather, road closures, customer delay, or other circumstances outside our reasonable control.
10. Passenger Conduct and Safety
Passengers must follow applicable law and reasonable safety instructions, use available seat belts as required, respect drivers and vehicles, and avoid conduct that is illegal, threatening, discriminatory, abusive, dangerously disruptive, or unsafe.
Smoking, vaping, illegal drug use, unlawful open containers, deliberate vehicle damage, dangerous interference with the driver, and passenger or luggage loads beyond safe capacity are prohibited. A driver may stop or refuse transportation when reasonably necessary to protect safety or comply with law. When service is ended because of a passenger's serious misconduct, amounts already earned and reasonable documented costs may remain due to the extent permitted by law.
11. Children and Child Restraints
Tell us in advance when a child restraint or booster seat is requested. Availability is not guaranteed unless confirmed, and a disclosed fee may apply.
Florida law assigns child-restraint responsibility to the parent, guardian, or other person responsible for a child's welfare when a chauffeur-driven taxi, limousine, sedan, van, bus, motor coach, or other passenger vehicle is hired for compensation. The responsible adult must determine and request the appropriate restraint, verify that it is suitable for the child, and secure the child correctly. Gulfshore Rides and its drivers will comply with other applicable safety requirements and may decline transportation that cannot be completed safely or lawfully.
12. Accessibility, Mobility Devices, and Service Animals
Gulfshore Rides does not discriminate on the basis of disability and will make reasonable service modifications as required by applicable law. Tell us about vehicle-space, mobility-device, transfer, or assistance needs when advance information is reasonably necessary to identify a suitable vehicle. We will not impose a disability-based surcharge.
Service animals are not pets. A person with a disability may travel with a service animal without a pet fee, deposit, certification requirement, or additional condition prohibited by law. Advance disclosure is not required merely because a service animal will travel. A service animal must remain under the handler's control and may be excluded only when permitted by law, such as when it poses a direct threat or is not under control after a reasonable opportunity to correct the issue. Neutral charges for actual damage caused by an animal may apply on the same basis as damage caused by any passenger.
13. Pets, Luggage, and Personal Property
Non-service pets require advance notice and confirmation. Customers must keep pets safe, clean, secured, and under control. A disclosed pet, cleaning, or vehicle requirement may apply; service animals are governed by the separate provision above.
Provide accurate luggage and equipment information so an appropriate vehicle can be assigned. Gulfshore Rides may assist with loading and unloading as a courtesy, but passengers must confirm that all property is loaded and removed.
You are responsible for personal belongings. We are not responsible for lost, forgotten, stolen, delayed, or damaged property except to the extent required by law or caused by our failure to use reasonable care. We may make reasonable efforts to locate and return an item. A separately approved delivery charge may apply to returning found property.
14. Cleaning and Damage
The booking contact and responsible passenger may be charged reasonable, documented costs to clean, repair, or restore a vehicle after unusual soiling or damage caused by a passenger, luggage, pet, or prohibited conduct. Ordinary wear is not chargeable.
Before collecting a material cleaning or damage charge, Gulfshore Rides will provide a reasonable description of the issue and, where practicable, supporting photographs, invoices, estimates, or other documentation. This provision does not authorize an arbitrary penalty.
15. Vehicles, Drivers, Substitutions, and Approved Partners
Vehicle images and descriptions are illustrative unless a specific vehicle is expressly confirmed. Gulfshore Rides may substitute a reasonably suitable vehicle or driver because of maintenance, scheduling, safety, capacity, or operational needs.
If Gulfshore Rides cannot serve a request, we may offer a separate option to have approved transportation partners review that request. We will share ride and contact information with partners only after affirmative, ride-specific authorization. SMS consent, full payment-card credentials, and unrelated marketing permission are not transferred.
An approved partner may provide its own availability, fare, terms, privacy notice, payment instructions, and confirmation. The customer will be told when the partner, rather than Gulfshore Rides, is the transportation provider or contracting party. Gulfshore Rides remains responsible for its own acts and does not disclaim obligations that applicable law assigns to it.
16. Delays and Events Outside Reasonable Control
Traffic, crashes, road closures, severe weather, flooding, airport or port congestion, security delays, government action, public emergencies, strikes, technology or communications outages, mechanical issues, inaccurate third-party data, and other events outside reasonable control may delay, reroute, or prevent service.
Gulfshore Rides will use reasonable operational efforts to communicate and respond, but is not liable for a failure or delay caused by an event outside its reasonable control to the extent permitted by law. This provision does not excuse payment refunds owed for a ride Gulfshore Rides cancels and does not provide, as described above.
17. Text Message Terms
Providing a mobile number, accepting these Terms, requesting a quote, submitting a contact form, or authorizing partner review does not by itself enroll you in recurring or automated text messaging.
If you separately opt in, Gulfshore Rides may send reservation-related text messages such as booking confirmations, reservation and pickup updates, payment links, driver or customer-support communications, cancellation notices, and payment receipts. Message frequency varies based on reservation activity. Message and data rates may apply. Consent to receive text messages is not required to request or book a ride.
Reply STOP to opt out. You may also communicate a clear opt-out request through another reasonable method. For assistance, reply HELP, email Book@GulfshoreRides.com, or call (239) 523-2222. After an opt-out, we may send one confirmation that the request was processed. We will not resume automated or ongoing reservation texts unless you provide new consent.
If you initiate a text conversation or specifically ask for a reply by text, we may send reasonable person-to-person responses about that inquiry. The inbound conversation does not enroll you in automated, recurring, marketing, or unrelated messages.
Carriers are not responsible for delayed or undelivered messages. Gulfshore Rides does not sell, rent, or transfer SMS consent, mobile numbers, or text-messaging opt-in data to third parties or affiliates for their own marketing or promotional purposes. Messaging providers may process mobile information only as needed to deliver and manage Gulfshore Rides communications. SMS consent is not transferred to a driver or approved transportation partner.
18. Other Communications
We may use the contact information you provide to respond to an inquiry, administer a requested or confirmed ride, address payment or safety issues, and provide customer service. Necessary service communications may be sent through an appropriate channel even when you have opted out of optional marketing or SMS, provided we honor channel-specific consent and opt-out requirements.
Marketing messages are optional and require any consent applicable to that channel. Marketing email will include a reasonable unsubscribe method.
20. Third-Party Services and Links
The website may use or link to third-party maps, payment processors, flight tracking, analytics, communications, accounting, social media, review platforms, and other services. A third party may operate under its own terms and privacy practices.
Gulfshore Rides is not responsible for an independent third party's website, outage, content, or conduct, but this provision does not disclaim responsibility for Gulfshore Rides' own selection, instructions, representations, or legal obligations concerning a service provider.
21. Website Content and Intellectual Property
Website content is provided for general information, trip planning, and booking. We try to keep it accurate, but route descriptions, travel information, availability, images, and estimates may change or contain errors. Confirm time-sensitive details before relying on them.
The Gulfshore Rides website, logos, original text, graphics, layouts, images, and other protected materials are owned by or licensed to Gulfshore Rides. You may use the public website for personal, noncommercial trip-planning and booking purposes. You may not reproduce, distribute, sell, misrepresent, or exploit protected content without permission, except as allowed by law.
22. Reviews, Feedback, and Customer Content
Nothing in these Terms restricts or penalizes an honest consumer review or requires a customer to transfer intellectual-property rights in a review, photograph, video, or other consumer evaluation. Customers remain responsible for content that is unlawful, knowingly false, threatening, harassing, infringing, or that improperly discloses confidential or private information.
If you send feedback or media directly to Gulfshore Rides and expressly authorize us to publish or use it, you grant only the non-exclusive permission reasonably necessary for that authorized use. Gulfshore Rides will not condition an incentive on a review expressing a particular positive or negative sentiment and will not knowingly publish a fake or materially misleading review or testimonial.
23. Disclaimer of Warranties
The website and online tools are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Gulfshore Rides disclaims implied warranties relating to the website, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted access, and error-free operation.
Transportation services will be performed with the level of care required by applicable law and the confirmed ride terms. Nothing in this section eliminates an express commitment in a written confirmation or a warranty that cannot lawfully be disclaimed.
24. Limitation of Liability
To the fullest extent permitted by law, Gulfshore Rides and its owners, employees, contractors, drivers, and agents are not liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the website or a ride, including losses associated with missed travel or appointments, when those damages were not caused by conduct for which liability cannot lawfully be limited.
Except for liability that cannot lawfully be limited, Gulfshore Rides' aggregate liability arising from a specific ride will not exceed the amount paid to Gulfshore Rides for that ride. These limitations do not apply to gross negligence or willful misconduct, and they do not limit liability for personal injury or tangible property damage to the extent such a limitation is prohibited by law.
Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply. You retain all non-waivable consumer rights and remedies.
25. Responsibility for Third-Party Claims
To the extent permitted by law, you agree to reimburse Gulfshore Rides for reasonable losses and costs resulting from a third-party claim caused by your intentional unlawful conduct, material violation of these Terms, knowingly false booking information, or damage caused by you, your passenger, luggage, or non-service pet.
This provision does not require you to reimburse Gulfshore Rides for its own negligence, gross negligence, willful misconduct, violation of law, or breach of these Terms, and it does not restrict honest reviews or lawful complaints.
26. Governing Law, Changes, and General Terms
Florida law governs these Terms without regard to conflict-of-law principles, except where federal law or another mandatory law applies. A dispute may be brought in a Florida state or federal court that has proper jurisdiction and venue. These Terms do not require arbitration or waive participation in a class proceeding.
Before filing a non-urgent claim, the parties are encouraged to contact each other and attempt a good-faith informal resolution. This informal step does not prevent either party from seeking emergency relief and does not extend or shorten a legal filing deadline.
We may update these Terms when services, operations, or legal requirements change. Revised Terms apply prospectively to website use, requests, and reservations after the stated effective date. An update does not retroactively create SMS, marketing, location, cookie, partner-sharing, or payment consent. A previously confirmed ride remains subject to the version and ride-specific terms accepted at confirmation unless a change is required by law or is separately agreed.
If a provision is unenforceable, it will be limited or removed only to the minimum extent necessary and the remaining Terms will continue. A failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, the applicable confirmation, and accepted ride-specific terms form the agreement for the website and ride. A specific written ride term controls over a conflicting general term for that ride.
We may suspend access, reject a request, or end service when reasonably necessary for safety, legal compliance, fraud prevention, operational feasibility, or a material violation of these Terms.
